The Telework Enhancement Act of 2010 requires Executive agencies to establish policies under which employees may telework. The intent of the Act is to encourage federal sector participation in telework to the greatest extent possible. Section 1 of Federal Sector Telework examines the Telework Enhancement Act and OPM guidance and surveys Executive agency policies implementing the Act. Section 1 topics include:
- Coverage
- Agency Responsibilities Under the Act
- Definitions: including the meaning of the terms "employee", "agency" and "telework" under the Act
- Eligibility: including position suitability v. employee eligibility and limitations to eligibility
- Participation: including denials for poor performance, training, mandatory written agreements and grievances
- Limitations: including discussion of telework limitations under the Act and reasonable accommodation requests
- Equal Treatment Under the Act
Telework is a workplace privilege, not a right, and there are limitations to teleworking under the Telework Act and its implementing policies. Those limitations sometimes conflict with other laws, in particular the Rehabilitation Act. Section 2 of Federal Sector Telework examines the intersection of the Telework Act and agency policies with EEO and MSPB principles and caselaw, making this handbook an essential reference to managers, supervisors, HR officials, and representatives of agencies and complainants. Section 2 topics include:
- Telework and the Terms and Conditions of Employment
- Denials of Telework
- Termination of Telework Agreements
- Telework and the Rehabilitation Act
- Telework as a Reasonable Accommodation
- Telework as a Religious Accommodation
- Telework Before the MSPB
